Parents will be able to allocate part of their working day to the education of their children thanks to a decree project that was approved by the House of Representatives.

It proposes the addition of a paragraph to Article 59 of the Federal Labor Law. in which it is noted that the Department of Labor will implement actions to promote flexibility during the working day with the objective of facilitating the participation of parents or tutors in school activities.

The document signed by the president of the Steering Committee of the House of Representatives, Dulce María Sauri Riancho and Mónica Bautista, secretary, notes that workers will not have the obligation of making up for working hours used for this end, as long as they accredit their participation with the school authorities.

A transitory article establishes that within a maximum period of six months, from the time in which the decree is published in the DOF [Official Gazette of the Federation], the Departments of Education and Labor will issue the necessary regulations for its observance.

If enforced, it will be a burden for companies, warned Ricardo Martínez, labor lawyer.

“It is a Norm totally lacking in clarity, it cannot be left to be ruled upon by the administrative authority, it will lead to widespread abuse and absenteeism which should not have to be paid for by the employer, even if the motive is justified”, he stated.

He added that since the decree states that the workers will not have the obligation of making up for the hours that they take for this effect, it means that they can use hours from the working day and that these hours will be paid.

Article 59 of the Federal Labor Law establishes that the worker and the employer will set the duration of the working day, without exceeding the legal maximums.

“The workers and the employer may divide the working hours in order to allow workers to rest on Saturday afternoons or any equivalent modality”, states Article 59.
